1. Scope of Application
These General Terms and Conditions (hereinafter referred to as GTC) apply to the rental of apartments and related additional services and deliveries by Pierre Sudan Leasing und Finanz AG (hereinafter referred to as Pit Stop Apartments) to customers. All offers by Pit Stop Apartments are based on the following GTC. They form an integral part of every contract. Should the present GTC conflict with any contractual conditions of a customer, the present GTC shall take precedence.
2. Conclusion of Contract
Following the reservation by the customer, they will receive a written reservation confirmation from Pit Stop Apartments. The contract between the parties is only concluded upon this written reservation confirmation from Pit Stop Apartments to the customer.
3. Services, Payments and Prices
Pit Stop Apartments undertakes to provide the services ordered by the customer and confirmed in writing by Pit Stop Apartments. All prices are in Swiss Francs (CHF) and include the statutory value-added tax (VAT). Pit Stop Apartments is entitled to request a reasonable deposit at any time. The amount of the deposit and the payment dates are agreed in writing in the contract or reservation confirmation. If the customer fails to pay the deposit by the due date, Pit Stop Apartments is entitled to withdraw from the contract after setting a reasonable grace period. The customer is liable for any resulting damages to Pit Stop Apartments.
If no deposit is requested by Pit Stop Apartments, the total invoice amount must be paid by the customer by credit card (Master, VISA, American Express, Diners, JCB), debit card (EC/Maestro, Postcard) or in cash at the latest on the day of arrival.
For bookings made directly through the website, Pit Stop Apartments is entitled to immediately charge the entire amount to the provided credit card on the day of booking.
If payment by invoice is agreed, the total invoice amount is due 10 days after the invoice date. In case of late payment, Pit Stop Apartments is entitled to charge interest on arrears at 5%.
Price changes by Pit Stop Apartments are expressly reserved.
4. Liability
The customer is liable to Pit Stop Apartments for all damages, losses or other harm caused by themselves, their employees, their agents or other third parties. Pit Stop Apartments declines any liability for theft and property damage brought in by the customer or by third parties. The insurance of items brought in by the customer or third parties is the responsibility of the customer. Pit Stop Apartments may at any time request proof of adequate insurance from the customer.
Pit Stop Apartments is only liable in cases of intentional or grossly negligent contractual or non-contractual damage, and only for direct damages. Any further liability, in particular for slight or moderate negligence or for indirect damages, such as loss of profit, is excluded.
The customer undertakes to fully indemnify Pit Stop Apartments from all civil and public law claims raised by authorities or third parties (including guests, employees and contractual partners of the customer) due to their stay against Pit Stop Apartments, and/or to cover all corresponding claims.
5. House Rules and Other Safety Regulations
The customer is obligated to comply with the house rules and safety regulations. These serve the purpose of safety and order. In case of violation of these provisions, Pit Stop Apartments is entitled to sanction the customer and, in severe cases, to withdraw from the contract in whole or in part. The customer may only use the rental property for the contractually agreed purpose as an apartment and in particular not for commercial or similar purposes.
The apartment may only be used by persons registered with Pit Stop Apartments. The regular or simultaneous presence of multiple unregistered or non-resident persons may be regarded as suspicion of use contrary to the contract or unauthorized use, in particular commercial use. Pit Stop Apartments is entitled in such a case to verify the identity of the persons present, to remove unregistered persons from the premises, and – depending on the severity of the violation – to terminate the rental agreement without notice and take further legal action.
6. Withdrawal by Pit Stop Apartments
If the performance contractually owed by Pit Stop Apartments is substantially impeded or rendered impossible, in whole or in part, due to force majeure or other circumstances beyond the control of Pit Stop Apartments, Pit Stop Apartments may withdraw from the contract in whole or in part for the unfulfilled portion without compensation.
Pit Stop Apartments is also entitled to withdraw without compensation if there are reasonable grounds to assume that the customer’s stay could endanger the smooth operation, security or public reputation of Pit Stop Apartments. Any claims for damages by Pit Stop Apartments against the customer are expressly reserved.
7. Check-in and Check-out Times
The apartments are available from 3:00 PM on the day of arrival and must be vacated before 11:00 AM on the day of departure.
8. Cancellation Conditions
The following cancellation conditions apply both to the cancellation of bookings and to no-shows and early departures.
A no-show occurs when the customer does not arrive at Pit Stop Apartments during check-in times, unless a different time has been agreed in advance. In case of a no-show, the entire booking amount is due.
Cancellations must reach Pit Stop Apartments at the latest 48 hours before the date of stay (by 3:00 PM local time). In case of cancellation within 48 hours before the date of stay, the apartment price for one night will be charged.
For cancellation of a booking made through the website and already paid, the booking amount will be refunded if the cancellation reaches Pit Stop Apartments at least 48 hours before the date of stay. In case of cancellation within 48 hours before the date of stay, the apartment price for one night will be charged.
For cancellation of so-called HOT DEAL or LAST MINUTE bookings, the entire booking amount will not be refunded in whole or in part. This applies to bookings made both directly with Pit Stop Apartments and through the website.
If separate cancellation conditions have been agreed for specific corporate customers, these take precedence over the GTC.
For all cancellations, services already rendered by Pit Stop Apartments and its partners must in any case be paid in full. Pit Stop Apartments reserves the right to establish individual contractual cancellation conditions.
9. Amendments and Additions
Pierre Sudan Leasing und Finanz AG expressly reserves the right to adapt and amend the present General Terms and Conditions at any time to reflect current circumstances and to apply them immediately.
10. Applicable Law and Jurisdiction
In case of disputes, Swiss law exclusively applies. The place of jurisdiction for natural and legal persons is exclusively Zug.
